By accessing or using Flexsee AI ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

1. Service Description

Flexsee AI provides AI-powered predictive analytics for e-commerce businesses, including:

• Customer behavior prediction using machine learning
• Product recommendation engines
• Audience targeting for advertising platforms (Meta Ads, Google Ads, etc.)
• Email marketing personalization (Klaviyo, Mailchimp integration)
• E-commerce platform integrations (Shopify, WooCommerce)

2. User Accounts

2.1 Account Creation

You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

2.2 Eligibility

You must be at least 18 years old and legally able to enter into contracts to use Flexsee AI. By using the Service, you represent that you meet these requirements.

3. Acceptable Use

You agree NOT to:

• Use the Service for illegal purposes or in violation of any laws
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to our systems or other users' data
• Reverse engineer, decompile, or attempt to extract source code
• Use the Service to spam, harass, or send unsolicited communications
• Resell, sublicense, or redistribute the Service without permission
• Exceed rate limits or abuse API endpoints

4. Data Ownership and Usage

4.1 Your Data

You retain ownership of all data you provide to Flexsee AI. We do not claim ownership of your customer data, product catalogs, or any information you upload. You grant us a limited license to process this data solely to provide the Service.

4.2 AI Models

AI models trained on your data belong to you. We do not use your data to train models for other customers. Your predictions and models are private to your organization.

4.3 Aggregated Data

We may use anonymized, aggregated data for analytics, service improvement, and research. This data cannot identify you or your customers.

5. Billing and Payments

5.1 Subscription Plans

Flexsee AI offers subscription-based pricing. By subscribing, you agree to pay the fees for your selected plan. Fees are billed in advance on a monthly or annual basis.

5.2 Free Trial

Free trials (if offered) do not require payment information. You can cancel anytime during the trial without charge.

5.3 Refunds

Subscription fees are non-refundable except as required by law or at our sole discretion.

5.4 Cancellation

You may cancel your subscription at any time. Upon cancellation, you'll retain access until the end of your billing period. No refunds for partial months.

6. Intellectual Property

6.1 Our IP

The Flexsee AI platform, including all software, algorithms, designs, trademarks, and documentation, is our property or our licensors'. You may not copy, modify, or create derivative works.

6.2 Your IP

You retain all rights to your data, content, and business information. We do not claim ownership of anything you create or upload.

7. Service Availability

7.1 Uptime

We strive for 99.9% uptime but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience technical issues.

7.2 Changes to Service

We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice. We'll notify you of significant changes via email.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Flexsee AI is provided "AS IS" without warranties of any kind
• We are not liable for indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid in the last 12 months
• We are not responsible for third-party services (Shopify, Meta, Klaviyo, etc.)
• AI predictions are estimates - we do not guarantee accuracy or business results

9. Indemnification

You agree to indemnify and hold harmless Flexsee AI from any claims, damages, or expenses arising from:

• Your use of the Service
• Violation of these Terms
• Violation of third-party rights
• Your data or content

10. Termination

We may terminate or suspend your account immediately if you:

• Violate these Terms
• Engage in fraudulent activity
• Fail to pay fees
• Abuse the Service or our systems

Upon termination, your access ends immediately and your data may be deleted.

11. Governing Law

These Terms are governed by the laws of England and Wales. Disputes will be resolved in the courts of England and Wales.

12. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Flexsee AI regarding the Service.
